Dubai Court Rejects Father's Dh6.9 Million Claim Against Son in Property Dispute

The Dubai Civil Court of First Instance has rejected a father’s lawsuit seeking nearly Dh6.9 million from his son, related to the proceeds of a family property sale. The court deemed the case inadmissible, citing that the dispute had already been resolved through earlier, binding final judgments.

The core of the dispute involved a family property, inherited by the father and his mother (the son's grandmother), which was subsequently sold for Dh8.1 million. The father alleged that his son, acting under a general power of attorney, managed the transaction and received the sale proceeds. The father claimed his share was not transferred to his personal bank account but instead deposited into a joint account with his son. He further alleged that the son then transferred funds from this joint account to his own accounts and used a portion for personal expenses.

While the father presented investigative records and an expert accounting report tracing the fund movements, the court did not look at these new allegations. It found that the current lawsuit involved the same parties, subject matter, and legal grounds as a previous case that had already reached a definitive conclusion. The court emphasised that a final judgment carries binding authority, preventing the same dispute from being litigated again, even if new documents or arguments are introduced.

Consequently, the court declined to reconsider the specifics of the disputed transfers or the son's explanations. The father's Dh6.9 million claim was dismissed, and he was ordered to cover the court fees and legal costs.
